Review the general rules governing access to and use of our website, booking systems, and digital platforms.
Santa Fe (hereinafter referred to as the “Company”) refers collectively to two legally registered and independent entities in Ecuador:
Hotel Santa Fe (commercial name), legally registered under Byron Antonio Rueda Ajoy, RUC No. 2000087540001, providing accommodation services in Puerto Ayora, Santa Cruz Island, Galapagos, Ecuador.
Yacht Santa Fe III (commercial name), legally registered under Yate Santa Fe YSF Cia. Ltda., RUC No. 2091767486001, operating maritime day tour services from Puerto Ayora, Santa Cruz Island, Galapagos, Ecuador.
This document constitutes the master Terms of Use governing access to and use of the Company’s websites, booking platforms, communication channels, and services. All related policies, including but not limited to the Terms and Conditions, Hotel Policy, Privacy Policy, and Insurance & Risk Notice, are incorporated herein by reference and form an integral part of these Terms.
These Terms of Use apply to all “Personas Naturales” over 18 years of age who access, book, purchase, or use any of the Company’s services.
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ecuador. Any dispute shall be subject to the jurisdiction of the competent courts of Ecuador.
By proceeding with a reservation, booking, payment, check-in, embarkation, or use of any service, whether directly with the Company or through any intermediary, you acknowledge that you have read, understood, and accepted these Terms of Use and all incorporated policies.
1. Modifications: The Company reserves the right to modify, update, suspend, or amend, at any time and without prior notice:
- Website content
- Service descriptions
- Availability
- Rates
- Technical systems
- Legal documentation
Updated versions of these Terms shall become effective upon publication on the website.
2. Acceptable Use: Users agree to use the website and booking systems lawfully and in good faith.
The Company reserves the right to refuse, suspend, or cancel any reservation, communication, or account that:
- Contains false, incomplete, or misleading information
- Uses unauthorized or third-party contact information without consent
- Involves fraudulent, abusive, or unlawful conduct
- Contains offensive, defamatory, or inappropriate content
- Attempts to interfere with the proper functioning of the website or booking systems
3. Responsibility for Information Provided: The Client is solely responsible for the accuracy and completeness of all information provided during booking, payment, or communication.
The Company shall not be liable for errors, omissions, or consequences arising from incorrect, incomplete, or inaccurate information submitted by the Client, including but not limited to identification details, travel dates, or contact information.
4. Intellectual Property: All website content, including but not limited to text, images, logos, branding, design elements, software, booking systems, and technical infrastructure, is the property of the Company or its licensors and is protected under applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written authorization from the Company.
5. Technical Availability: The Company does not guarantee uninterrupted, error-free, or continuous access to the website, booking engines, or payment systems.
Temporary interruptions may occur due to maintenance, updates, technical issues, third-party service providers, or circumstances beyond the Company’s control. The Company shall not be liable for any damage resulting from such interruptions.
6. Website Integrity: Any attempt to interfere with, manipulate, alter, reverse-engineer, or compromise the technical integrity of the website, booking engines, payment systems, or source code may result in immediate cancellation of services and notification to the appropriate Ecuadorian authorities.
